Commencement Notices

A Commencement Notice is a formal notification to a Building Control Authority indicating an intent to perform works or a material change of use that falls under the Building Regulations. This notice must be submitted to the authority no more than 28 days and no less than 14 days before starting the works or making the change of use.

Upon validation by the Building Control Authority, the construction or change of use must commence within the 28-day period.

Do All Developments Require a Commencement Notice?

Commencement Notices are mandatory for the following activities:

  • Erection of a Building: Constructing a new building.
  • Material Alteration of a Building: Making significant changes to the structure of an existing building.
  • Extension to a Building: Adding to an existing building.
  • Material Change of Use of a Building: Changing the purpose or function of an existing building.
  • Works on Shops, Offices, or Industrial Buildings: In connection with material alterations, provided a Fire Safety Certificate is not required (excluding minor works).

Exemptions from Commencement Notices

A Commencement Notice is not required for:

  • Works or changes of use that do not require planning permission or a Fire Safety Certificate.
